Terms of use

Effective November 1, 2026. These terms govern your use of novadventure.com. Please read them; by using the Site, you agree to them.

1. About these terms

These terms of use (the “Terms”) are an agreement between you and Nova Adventure LLC (“Nova Adventure,” “we,” “us” or “our”), a company located at 3209 Mercantile Court, Santa Fe, NM 87507, United States. They govern your access to and use of novadventure.com and any pages, tools and content on it (together, the “Site”).

By accessing or using the Site, you agree to these Terms. If you are using the Site on behalf of an organization, you confirm that you have authority to accept these Terms for that organization. If you do not agree, please do not use the Site.

2. The Site and our services are different things

The Site describes our company, platform modules, services and engagement models. It is provided for general information only. Nothing on the Site is an offer to sell, a quote, or a commitment to provide any product or service.

Our platform and services are provided only under a separate written agreement, such as an order form, statement of work, subscription agreement or data processing terms. If there is any conflict between these Terms and a signed agreement with us, the signed agreement governs.

3. Using the Site

You may use the Site for lawful purposes, including learning about Nova Adventure, contacting us, and evaluating whether to work with us. When you use the Site, you agree not to:

  • use it in a way that breaks any applicable law or regulation;
  • attempt to gain unauthorized access to the Site, its hosting infrastructure or any connected system, or test its vulnerabilities without our written permission;
  • interfere with the Site’s operation, including by introducing malware or by sending requests at a volume that places an unreasonable load on it;
  • circumvent security or spam-protection measures, including the checks used on our contact form;
  • submit false, misleading or unlawful information through the contact form or otherwise impersonate any person or organization;
  • use the Site to send unsolicited commercial messages; or
  • use content from the Site in a way that suggests a partnership, endorsement or affiliation with Nova Adventure that does not exist.

Automated access. We want our public pages to be discoverable, including by search engines and AI assistants. Automated tools may access public pages of the Site if they respect our robots.txt file, identify themselves honestly, and do not place an unreasonable load on the Site. We may block automated access that does not meet these conditions.

4. Information you submit

When you contact us through the Site, you agree to provide accurate information and to send only information you have the right to share. Please do not submit confidential information, traveler personal data or payment details through the contact form. If a conversation needs that kind of information, we will arrange an appropriate way to exchange it, often under a non-disclosure agreement.

How we handle personal information you submit is described in our privacy policy.

If you send us suggestions or feedback about the Site or our products, you agree that we may use them without obligation to you. This does not apply to confidential information you share with us under a separate written agreement.

5. Intellectual property

The Site and its content, including text, illustrations, graphics, page designs, interactive tools and software, are owned by Nova Adventure or its licensors and are protected by copyright, trademark and other laws. “Nova Adventure,” our logo, and the names of our platform modules are trademarks of Nova Adventure LLC.

Subject to these Terms, you may view and print pages of the Site for your own informational use, share links to it, and quote short excerpts with attribution to Nova Adventure and a link to the source page. Any other copying, modification, distribution or commercial use of Site content requires our prior written permission.

6. Examples, estimates and interactive tools

The Site includes worked examples, hypothetical scenarios, anonymized case studies, pilot measurements, and interactive tools such as the ROI calculator, the AI readiness assessment and the re-planning demonstration. These are provided to illustrate how our products and methods work. They are not guarantees of any particular result in your business.

Pilot measurements reflect specific engagements and conditions and are labeled as such. Results from the ROI calculator and the readiness assessment are estimates based on the inputs you provide and the assumptions stated on those pages. Before relying on any estimate for a business decision, please discuss it with us or your own advisers.

The Site may link to websites or services operated by others, such as map providers or sources we cite in our articles. We do not control those sites and are not responsible for their content, availability or practices. Your use of them is governed by their own terms and policies.

8. Disclaimers

We work to keep the Site accurate and available, but we provide it “as is” and “as available.” To the fullest extent permitted by law, Nova Adventure disclaims all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, secure or free of errors, or that any content is complete or current.

Content on the Site is not legal, financial, safety or travel advice. Any statements about weather, terrain, accessibility or destinations are general and illustrative, and are not a substitute for current local information.

9. Limitation of liability

To the fullest extent permitted by law, Nova Adventure and its members, managers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of, or inability to use, the Site, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

These limitations apply to your use of the Site only. Liability relating to our platform and services is governed by the written agreement under which they are provided.

10. Indemnity

If you use the Site on behalf of a business, that business agrees to indemnify and hold harmless Nova Adventure from claims, losses and reasonable costs, including reasonable legal fees, arising from a breach of these Terms or from misuse of the Site by you or anyone acting on your behalf.

11. Suspension

We may suspend or restrict access to the Site, or to features such as the contact form, if we reasonably believe it is being misused or that doing so is necessary to protect the Site, our team or other users.

12. Governing law and disputes

These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. You and Nova Adventure agree that any such dispute will be brought exclusively in the state or federal courts located in New Mexico, and both consent to the personal jurisdiction of those courts. If you live outside the United States, this section does not deprive you of any mandatory consumer protections under the law of the place where you live.

Before filing a claim, we ask that you contact us at welcome@novadventure.com so we can try to resolve the issue informally.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Changes apply from that date. If you continue to use the Site after a change takes effect, you accept the updated Terms.

14. General

If any provision of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable provision will be applied to the greatest extent permitted. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with our privacy policy, are the entire agreement between you and us regarding the Site, and they do not create any partnership, agency or employment relationship.
